1. Agreement to Terms
By accessing or using Org1 ("the Platform"), operated by Org1 AI, Inc., you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all visitors, users, and others who access the service.
2. Description of Service
Org1 is an autonomous organization-building platform that uses artificial intelligence to research, build, launch, and grow businesses on behalf of users. The Platform may autonomously generate content, create landing pages, send emails, post to social media, and perform other business operations. You acknowledge that AI-generated outputs may require review and that you are ultimately responsible for the businesses and content created through the Platform.
3. Account Terms
You must be at least 18 years old to use the Platform. You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account and for all activities that occur under it. You must notify us immediately of any unauthorized use.
4. Autonomous Operations
The Platform performs actions autonomously on your behalf, including but not limited to: market research, content generation, landing page creation, website and application building, email campaign execution, social media posting, and business optimization. By using the Platform, you authorize these autonomous operations and acknowledge that:
- AI-generated content may not always be accurate, complete, or suitable for your purposes.
- You are responsible for reviewing and approving autonomous actions where applicable.
- Org1 is not liable for business decisions made or executed by the Platform's autonomous systems.
- Outbound communications (emails, social media posts) sent by the Platform on your behalf are your responsibility.
5. Acceptable Use
You agree not to use the Platform to:
- Engage in any illegal activity or violate any applicable laws.
- Infringe upon the intellectual property rights of others.
- Distribute malicious code, spam, or unsolicited communications.
- Harass, abuse, or harm other individuals or businesses.
- Create businesses or content that is fraudulent, deceptive, or misleading.
- Circumvent or interfere with the Platform's security features.
6. Intellectual Property
The Platform, including its design, code, features, and branding, is the exclusive property of Org1 AI, Inc. Content generated by the Platform on your behalf is owned by you, subject to any third-party rights. You grant Org1 a non-exclusive license to use, display, and process your content solely to operate and improve the Platform.
7. Subscription & Payments
Premium features require a paid subscription billed monthly via Stripe. By subscribing, you authorize recurring charges to your payment method. Subscriptions may be cancelled at any time; cancellation takes effect at the end of the current billing period. Credits included in your plan are reset (not accumulated) each billing cycle. Refunds are not provided for partial billing periods or unused credits.
8. Business Marketplace
The Platform operates a marketplace where businesses created on Org1 may be bought and sold. By using the Platform, you agree to the following marketplace terms:
- Inactive businesses. If you do not access your business dashboard for seven (7) consecutive days after creation and have received at least two reminder emails, your business may be automatically listed for sale on the marketplace at a fixed price of $49. Org1 retains 100% of proceeds from the sale of inactive businesses. You will be notified via email before any automatic listing occurs.
- Subscription cancellation. Upon cancelling your premium subscription, your business may be listed on the marketplace at a price determined by Org1's AI pricing system based on the business's content, activity, and investment history. Org1 retains 100% of proceeds from AI-priced cancelled-business sales.
- Voluntary listings. Active subscribers may voluntarily list their business for sale at a price they set. Org1 charges a tiered commission on completed sales: 30% (under $500), 25% ($500–$5,000), 20% ($5,000–$50,000), or 15% (over $50,000). The remaining proceeds are credited to the seller.
- Ownership transfer. Upon a completed marketplace purchase, all digital assets associated with the business transfer to the buyer, including generated content, landing pages, application data, prospect lists, outreach history, and analytics. The buyer assumes full responsibility for the business and its data.
- All sales are final. Marketplace purchases are non-refundable. Buyers receive ownership of the business as-is, including all existing content, data, and configurations. Org1 makes no warranties regarding the future performance, revenue potential, or accuracy of any business or its associated data.
- No direct communication. All marketplace interactions are mediated by the Platform. Buyers and sellers may not contact each other directly through the marketplace. An AI assistant is available on each listing to answer buyer questions about the business.
9. Third-Party Services
The Platform integrates with third-party services (including AI providers, email services, social media platforms, and domain registrars). Your use of these services through the Platform is subject to their respective terms. Org1 is not responsible for the availability, accuracy, or practices of third-party services.
10. Termination
Org1 may suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. You may terminate your account at any time by contacting us. Provisions that by their nature should survive termination will survive.
11. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. Org1 does not warrant that the Platform will be uninterrupted, error-free, or that AI-generated outputs will be accurate, complete, or fit for any particular purpose.
12. Limitation of Liability
To the maximum extent permitted by law, Org1 AI, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising from your use of the Platform or any autonomous actions performed by the Platform on your behalf.
13. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in Delaware.
14. Changes to Terms
Org1 reserves the right to modify these terms at any time. We will notify users of material changes by posting the updated terms on the Platform. Continued use after changes constitutes acceptance of the revised terms.
